Apple Loops Copyrights

Hello,

I filmed a video years ago and used Apple Loops to compose a short sound track for it and posted it on YouTube.

Now years later there is a company

  • [Merlin] Symphonic Distribution
  • On behalf of: Orange Juice Media Group Digital

Claiming copyright infringement. How do I resolve this? Flying With Falcons - YouTube

Haha! I immediately recognised it, as I have also used that as the basis for an instrumental song a few years ago. I've never uploaded it - until I read your post just now - but not because of copyrights concerns; I just wasn't happy with the sound of the rythm section.
The conditions for using Apple loops are VERY clear: you can freely use them in new arrangements, or even completely standalone, and they are fully free of copyrights.

The article says Garageband, but it also applies to Logic Pro.

I think what has happened here is that some software detected this. I have once gotten a notice from Soundcloud because the title of my song matched that of a movie ("Goobey to all that"). They swiftly retracted it and blamed it on the software.

I found this old topic about an issue much like yours:
Google Groups

The fact that that topic stopped in 2013 is probably a good sign. Angry people keep posting, relieved people go on with whatever was interrupted.

Summary: if worst comes to worst: you are within your rights and they are not. I'm not a lawyer, but if the case would even be admitted to court, you will win.

Here's my use of those loops. The lead vocals are also Apple loops:

Eh, you must have misread. It very explicitly says you can use the content royalty free. The exceptions are listed at the end. The use by this OP is not listed as such an exception.

"…individual Sample Content assets may not be commercially or otherwise distributed on a standalone basis, nor may they be repackaged in whole or in part as audio samples, clipart, music beds, sound effects, sound files, sound libraries, stock animation, or similar assets."

Logic Pro X and MainStage 3: Using the included royalty-free content in commercial works - Apple Support

"…all Sample Content included in the Apple Software may be used on a royalty-free basis to create your own original soundtracks for your film, video, and audio projects. You may broadcast and/or distribute your own soundtracks that were created using the Sample Content."

Agree. I thought it was conflicting, but wasn't sure if I was supposed to read it as just putting the audio with a video as a music bed and that wasn't allowed if you didn't alter it. I didn't think that made sense, but so often lawyers don't make sense to us engineers. 😉

Given the link you posted it makes me feel better about my use and agree it's as you say, royalty free. Just don't put it out there and try to claim as your own essentially. Although at least one VP of the USA managed to get away with it!

Thanks for that!

Thank you for your response and research. Very much appreciated. I am disputing it through YouTube but YouTube is not directly involved with the dispute. It is directly with the claimants that have attached their Title of the disputed tune to my video. Isn't it curious that they used the exact same group of loops to create a song that they claim to have written?
