Is ear wax toxic?

Since we in California can no longer talk on our IPhone while driving after July 1 without a hands free device, I was thinking of investing in a pair of those expensive ear plugs that supposedly enhance the music experience. (I've got a Jawbone for plain old talking.) I learned, however, you can't actually listen to these $199 plugs before you buy them. I guess ear wax is more dangerous than I imagined. Do you have to just buy them and return them if they're not much better than what comes with your IPhone? Seems pretty dumb.

I bought a Motorola Bluetooth device online, and when it arrived, it was in the original packaging, but totally crusted with someone else's earwax. OMG can you say GROSS! If you are going to take a return and then resell it, would you at least LOOK at it before you ship it back out? I mean, you could see the earwax on the thing right through the packaging. It went straight back to them with a very nasty note.
