Apple states that it can be new or refurbished.
I know that in our case the phone was new based on the build date. Apple just ended week 36 and the phone my daughter received was built in week 35. I think most people are getting new phones... in 6 months this may be a different story. Getting a refurbished unit in the computer industry --- is very much a standard procedure. Apple is no different than HP, Epson, Dell, etc...
