I agree that there is no good reason for Apple to remove the '08 link for users who bought it. It would have been much more decent if they had done so.
However, neither to I see any good reason to expect them to keep it. You downloaded it once, and you had the opportunity to make a backup of it, just like you hopefully wrote down the license number.
Computers of all brands crash. Software of all kinds is pulled for different unexpected reasons from download sites of all companies. Knowing this, one would expect the vast majority of users to make backups of their programs, so Apple did not +have to+ keep the download.
I am fully aware that not all users think about making backups. It is not obvious that one has to, unless one is told to. However, it will make your life much easier, if you make one in the future.
