No UK Returns for faulty iPhone 4

Apart from hopefully Tesco

Hi Guys. I am still hoping for a solution from Apple. Just an update, to try and help you guys in the UK. Tesco Mobile promised me a full refund if I return it within 14 days. However, when I went into the town centre today at County Durham, I popped in a few shops to query returns. Orange Flat out said it's got nothing to do with them and no returns are not available, have to talk with Apple. 02 said buy a bumper and also dont touch the phone with your hands at the bottom, but refused to offer any refund. When I demonstrated the fault in front of their staff she said well don't hold it there, and offered me a bumper from behind the counter. I asked why should i buy a bumper to make something work that should already work. She basically just fobbed me off, and said goodbye. Vodafone said no returns until it is guaranteed to be a faulty product. Carphone warehouse and Phones U said exactly the same. There is no returns policy. Hopefully with Tesco being a Supermarket their returns procedure is a little less Fixed by Apple..I asked each store straight could i return an iPhone that does not work as a phone and they ALL said NO

I'm with Orange; my last two phones were HTC (M100 and Tytn II); I upgraded to an iphone 4 on-line; received it on 25th. I have problems with the grip induced signal drop-off but have had quite a few calls just cancel; not sure if this is to do with the proximity sensor. I need a reliable phone that I can just pick up and it's clear the iphone is not it! Plus I've found out that I can't tether unless I pay £5! I have 7 working days to advise Orange that I'm returning it; they don't care why. If Apple don't acknowledge the issue by tomorrow I will get shot of the iphone and get a Desire or Samsung Galaxy S.

There is no phone like iPhone out there. It all is down to the iOS. If some1 will manage to run ios on a different device i will go for it, but at the moment ip4 is the best phone on the planet even with the reception issue :/

I don't want to return it as there is no screen like this out there...

And yes you can cancel you contract even if it was ulgrade!

Purchased my iphone 4 from an Orange shop in Leicester on Launch day. Rang them today, said I wanted to return he phone due to reception issues and they said they dont have a 14 day return policy! and that it is not a fault with the phone, hold it differently..

Have I got any right to return this contract?

thanks

well 14 days is only if it is in your contract - read it

as for returning faulty goods - well you have to prove it is faulty, if the shop doesnt agree with you, you have the right to challenge that in a court

If the phone drops calls then it is not fit for purpose. if the phone drops signal bars during use then that is irrelvant.

(uk) When you return the phone within 6 months from date of purchase it is up to the retailer to prove there is no fault with the item. Phone contracts are for the airtime with a network, and will be binding unless the network cannot offer the service under the contract.

Same boat as u goodie.

O2 upgrade comes with you having to sign a waver on being able to cancel the contract within 14 days.

If your like me and upgraded and traded your old iphone in at the same time your goosed twice over.

Your best asking Citizens advice or trading standards about this one.

If your smart and you purchased via you Credit card then they are equally liable, you might not get far with O2 if that's the case get onto you bank.

I don't know if it's a case of they were sold as one 'product' and therefore both are faulty, or if O2 would offer a comprimse of a alternative handset etc on the same contract.

In the United States, I've heard rumors of people organizing class action lawsuits to recoup their losses. If Apple or AT&T is willing to allow them to return their phones and leave their renewed contract without penalty, I say there is no need for a class action suit. However, if a refund is refused and/or the wireless contract is not reverted to the state it was prior to purchasing the defective iPhone4, I would not see a class action suit as evil.
