I really want to get his pictures off of it and eventually use it as my own. I have his id but no password and theres a passcode on the device. I dont want to loose the recent pictures of him. Being as that i dont have many of pictures of him. Is there a master code i can enter or am i doomed to loose all pictures but recieve a paper weight

It doesn't matter where you bought it. The Apple store is the best way, buy you can also contact Apple Support and arrange to send them copies of the documentation. There's a link at the top of this page.
If he ever backed up or synced his iPhone with a computer you can get an iphone backup extractor program for the computer and view and save the contents of the backup.
