Apple Sound Effect Rights

I just made a short Instagram video and used one of the Apple iLife Sounds Effect Jingles ("First Snowfall.caf") and Instagram pulled my video because of the music rights. There is no way to follow up with Instagram to let them know. Did Apple rescind legal rights to their FCP music?

Online services like YouTube, Vimeo, and Instagram cannot be a "party" to copyright infringement. They all have content-matching algorithms that flag when copyrighted material has been used before... and copyrighted by somebody else... first.


You still have the right to use Apple Loops audio. You've paid for the licensing (it's part of the purchase price of FCPX and Logic — and partly of your Mac since Garageband and iMovie are "free".)


But here's the rub: these sound effects and jingles have been around for more than 10 years. *THOUSANDS* of people have used *all of them* in their copyrighted works.


So what can you do?


You must copyright your videos — NOT in a description, but actually IN the video itself. [The format is: ©YEAR by your name or your doing business as name, etc.] You SHOULD always CREDIT the media that you use that you do not own, again, in the video itself. That means that every video that you produce, you must provide a credit section in you video. I like to add: it's the professional thing to do.


Credits don't have to be fancy and they don't have to last that long; they don't have to be placed over video clips [a blank screen will do] and they don't have to be accompanied by sound. They can be completely apart from your work — just a fade out at the very end... and since you've got to place the copyright notice in there — you might as well go whole hog — list all the clip sources, sound sources, if you have any people in your clip, give them all mention, etc. etc. etc. [On the other hand: credits are an art form in themselves ;) I really enjoy the credits from Deadpool :D].


Once you have taken the responsibility for your copyrighted work, the online services will leave you alone. [If they don't, you have plenty of grounds to challenge them on!]
