If he stole it, contact the police and report the theft. Since he knows your screen lock passcode, there is no way for you to lock it. You can erase it if you wish. But since he stole it, get the police to get it back for you.

If you erase it you will no longer be able to remote track it as everything will be erased, including the remote connection that allows tracking. The thief will not be able to setup and use it though as long as you leave that device linked to your AppleID as one of your trusted devices as activation lock will prevent anyone from using it - Find My iPhone Activation Lock - Apple Support

No, to complete activation and setup of an erased but activation locked phone one needs to know the AppleID and password the device is linked to. Once erased, there is no screen lock passcode in effect since the phone must be setup anew for that, which cannot be done without the AppleID password.

When setting up an erased device, if you have another device of your own nearby (as in right next to each other on the same WiFi network), you can link the two to set the new one up, and that needs the passcode to start that restore, but setup on the erased device still cannot be completed without knowing the AppleID and password tied to the device.

Micheal I do really appreciate your replies . I just try to ease the phone that am currently using yes it worked everything erased automatically and was asked to set up the phone either by the previous appleID or previous screen passcode ... my question here is that the thief still knows the screen passcode and can easily set up the phone with the passcode even if I remotely ease the phone.... what do I do now ? Please
