entering my apple id when someone elses id is already logged in?

I am trying to log into my Apple ID onto a new iPhone I just got but the previous owners Apple ID is already logged in and it is asking for their password to log out?

If the phone has activation lock (i.e. Find iPhone is 'on') contact the previous owner, only he/she can potentially help you : Turn off Find My iPhone Activation Lock - Apple Support
