I can’t get into this new phone because the previous owner didn’t know there Apple ID or password anymore

Ask the previous owner to find their id : If you forgot your Apple ID - Apple Support

And to reset the account's password : If you forgot your Apple ID password - Apple Support

If they can't, ask for a refund
