I purchased an apple watch and have no way to get in touch with the seller to have them take it off their account what do I need to do

If the watch is locked by Activation Lock you MUST have it released by the original owner who set the lock. There are no workarounds, no backdoors. If you can’t get them to delete the device from their Apple ID to unlock it the watch is an expensive paperweight, you can never reconfigure and use it.
