I bought an ipod touch 1st gen today and i booted it up on iOS 3.1.3, i unlocked it and it told me how to edit my home screen. i pressed dismiss and it wouldn’t go away. and no. the screen/digitalizer isn’t broken because i was able to play music from the lock screen, reboot it and unlock the device. please help!

Begin by trying to re-start the iPod.
On that model, if I remember correctly, press-and-hold both the power button and the home button until the Apple logo appears. Then let it boot up.
it only started happening when i upgraded to 3.1.3, itunes told me to so i did, and that happened. it was on 2.1.3 i think. anyway to downgrade it even further? itunes doesn't like downgrading from iOS 3.

no luck, it appears a second after i unlock the phone though.
i did that too, even downgrading to 3.1.2 :/

In that case, try connecting it to iTunes and using iTunes to Restore the iPod.
