Will the iPhone XS and XS max have night mode? If not, how do we get apple to listen to us to put night mode on the XS?

Actually, I think you got it wrong.
The OP talks about the Night Mode in the Camera app and not the system Dark Mode. Night Mode won't be available on iPhone XS and iPhone XS Max, because it requires A13.
Also there is an app called Neural Cam that does rlly nice night shots
Yes, using iOS 13 (it will be released next week).

If you want the night mode, you‘ll need the iPhone 11 or the 11 Pro / Pro Max.
