i have just bought an iPhone XS Max and have set it up by transferring my old sim and putting it into my new phone and everything is great until I realised FaceTime was missing and when I go to download it it say that my device is “not applicable” for this app. Any suggestions?

If the phone was originally sold in one of a number of countries in the Middle East, it will never have FaceTime.
It is heavily regulated or outright banned by law in much of the Middle East.

Unfortunately that XS Max 64GB was manufactured for Saudi Arabia market, where Facetime is prohibited by local law.

No, sorry. FaceTime won't work on that device (unless laws change in Saudi Arabia).
