iCloud unlock original owner dead

In the case that the original owner died and no one has the iCloud password, these mean that the iPhone and iPad are useless?

Please see How to request access to a deceased family member's Apple accounts - Apple Support

Note that you will need to know the Apple ID, and will be required to obtain a Court Order.
