I want to use my right to claim $25. My phone got pretty slow.

You have no “right” to a darn cent. And if your phone got slow just replace the battery. If you had an iPhone in 2017-2018 you MIGHT be eligible for a payout after the suit is settled, probably in 2-3 years. The court has a list of users who might be eligible; if you are you will be notified at that time.

Well, past performance is no guarantee of future results. But in general the way class action settlements work is:

  • The court approves the settlement
  • The law firm that represents the plaintiffs (or an appointed administrator) gets a list of potentially eligible consumers from the vendor (in this case, Apple)
  • The administrator attempts to contact the eligible parties via email, snail mail, and public announcements
  • A website is created where eligible parties can file claims
  • There will be a deadline for filing claims; nothing will happen until after that deadline
  • Once all of the permissible claims have been filed the administrator and the court will figure out how much each plaintiff gets by dividing the number of filed claims into the total settlement (less the primary plaintiffs and the lawyer’s fees)
  • Settlement checks will be sent to the qualifying plaintiffs by the administrator.


One important thing to note is that, while Apple provides the funds, the distribution is usually managed by the administrator.


This process typically takes 1 to 2 years.

  1. You live in the USA, and did in 2017-2018.
  2. You owned an iPhone 6S or later during that time.
  3. You wait a year or two until the settlement is finalized and accepted by the court
  4. The amount you get is currently undetermined, and won’t be known until everyone who is eligible files a claim. It is currently estimated to be $25, but that could change.

What you're describing has absolutely nothing to do with the slowdown and even if you got your phone a year ago, it's a 5 year old phone (6s was released in 2015). The battery is very likely in need of being replaced, which is what your issue is.


If you think a 5 year old Samsung would hold up better, get one. But older Samsungs don't usually fare as well as older iPhones.

On March 2, 2020 various news media published that Apple had agreed to a class action settlement regarding slowdowns of some iPhone devices whose batteries were failing. Note that this is still tentative, and could change, but as of March 2, 2020 this is what we know (based on published news):

  • This is a PROPOSED settlement of a class action suit, based on a claim that Apple deliberately slowed down some phones, which Apple denies, but is willing to settle to avoid protracted litigation.
  • Apple will set aside $310 Million to $500 Million in the PROPOSED settlement.
  • Under the PROPOSED settlement the original plaintiffs will get $3,500 each.
  • Under the PROPOSED settlement their lawyers will get $93 million.
  • The settlement has not been approved by the judge in the case, and until the judge approves it (or requires it to be modified) no one is getting anything.
  • It applies only to owners of the 6, 6S, 7 (and their Plus versions) and the SE who had installed specific versions of iOS.
  • Eligibility is users who reside in the US and purchased their phones in the US, and who have experienced slowdowns due to battery degradation.
  • The $25 is an estimate, it could be more or less depending on how many claims are filed.
  • Once the settlement (or its modified version) is approved by the court a procedure will be published for filing claims.
