Bought an Apple Watch from someone and they never factory reset it

How would I do that without their phone present and I don’t know their passcode ?

You need to contact them to remove the Activation Lock. If you cannot contact them, or they cannot remove the lock, the device is useless to you. You will not be able to ever activate it.
