The person that you bought/got this watch from needs to follow all the steps in this link;
Remove the Activation Lock so that the buyer can use it.
If they can't or won't then get your money back or recycle the watch and mark it down as a bad experience.

Do they still have the iPhone paired with the Watch? If so, they can go into the Watch app> General> Reset.
Try to Press & hold the crown button until the message pops up to reset to factory setting.

I’ve tried to do the side button first and the crown after but what pops up is the passcode
It was the peer I had found the watch and returned it to them but the had bought a new one so they were happy to see it returned so they rewarded me with the watch
They "rewarded" you with an unusable device.
They did not remove the activation lock from it.

Only the original owner can remove the activation lock full stop.
If it’s not activated lock and only passcode. Just press and hold the crown button until the factory reset pops up. Then you will be able to access it. Make a new passcode.
