As you will discover, unless you are the owner of the AppleID that was last used to activate the device, or unless you can secure the cooperation of the previous owner, you’ll not be able to defeat or bypass the Activation Lock. Without documentary evidence that you are the original owner (such as sales receipt showing the serial number), Apple won’t assist - and nobody here will be able to help you.
A close family member may have adequate information to recover access to the owner’s AppleID credentials that previously activated the device. The following is written from the perspective of the owner, but you’ll get the idea...

No one here can help with that.
You need the death certificate, the will showing that you are now the legal owner, and the original purchase receipt - take those items to Apple and they will help you.
Doesn't matter if it is not stolen, you need the original owner to help.
Apple will only help if you have the original Apple receipt.
Activation Lock is a theft deterrent feature with no bypass or workaround.
Without the owner's authorisation, no thief or anyone including you can re-use the device.
Sad that it is this hard to unlock the device, that's why i don't purchase apple products
