What if I brought a phone from someone who didn’t previously own the phone but lied to me?

Someone sold me a iphone online that has been reseted, I couldn’t get in so I ask the person to remove the phone from their account, but he told they didn’t own the phone and they won’t give me my money back so I got scammed. Can I ask the original owner if I can keep it and if the can remove the device?
