question is 1 can i somehow get into the phone to get the photos off it? if so how do i do it when the itunes cant find the device and when i log into itunes account none of the old photos are there, seemingly apple delete them after a period of time? if its not possible then at least i know
You cannot get photos off the phone if you have forgotten the passcode.
Apple has no access to your content, and thus never can delete your content, so if it isn’t in iCloud you never synced it to iCloud.

If you don't know the passcode, you cannot get into the phone without using a computer to remove the passcode. This may or may not delete the data on it as well: https://support.apple.com/en-us/HT204306.
