Bought new Apple Watch from previous owner

Bought a watch from a person that paid it off at the store while I was there and then called Apple support and had it disconnected from his account but there is still an activation lock on the watch associated to the previous owner. He called again and said it was off his account. What can I do to get the activation lock off the watch (the previous owner is still responsive).
