Copyright problems with Soundcloud as I used Apple Loops only for my own song

Hello,


I have some issues with Soundcloud as I used Apple Loops only for my own song. I know I have the legal right to do so as stated by Apple.

I created a melody and my own lyrics to sing a new song based on the loops but SoundCloud wrongly identifies it as copyrighted !

What can I do as discussion with such a big platform is not easy ?

It appears they decide and I only have to comply. Let's hope they do not shut down my account !

But, should they not know about that ?


Any comment that could help is welcome.

In my songs I usually use Apple loops in the background but, for one song and this one only, I had an idea based on Apple loops only.

My idea was to sing on the loops with a melody and lyrics I created.


The problem is that SoundCloud doesn't see it that way and finds it similar to https://www.youtube.com/watch?v=1uqccZNAHhc

which it is. If you listen to that track it is the same as mine but without all the vocals I added. Only made with Apple loops.


As for the copyright thing, as I understand what Apple says, they own the copyright on the loops https://support.apple.com/en-us/HT201808 but these loops are royalty -free loops so we are free to ouse them.


For example in France, there is a famous singer that just took some Apple loops, just as they were, added vocals and released it as a new song which was a hit. People said it was not fair to do so but she had all the legal rights to do that. And she did just that.

For the sake of clarification, let's say I did the same thing.

Just to let you know, you were right. I just got my track back on SoundCloud !

The SoundCloud team just sent me an email.

In the next few days, I’m going to try to release this same track on my YouTube account. We’ll see what happens then !

Old issue and less prevalent these days. Do you know who claim the "copyright"? There are few rights trolls who register everything they can.


You can also reach Apple for support.


You're right: It is not easy to deal with these platforms. Depending of your region, your mileage may vary.

Actually it is the automatic identification tool from SoundCloud that identifies it similar to another song and... they are right as the previous person just put online the same Apple loops as I did, period.


But the thing is, I did more than that (I mean just put the Apple Loops online as the other one did).


Based on those loops I invented a whole song with melody, lyrics. I did much more to create something new than the previous person.


Problem is that everything is automatic here. There seems little chance that they are going to think more than one second about my arguments. Such a shame and not really fair.

Yes. This is exactly the issue I referred to. Digital rights trolls taking advantage of automatic rights detection. It is an issue on many social media platforms like YouTube. Now they try to tamper the problem by prohibiting the use of automatic rights detection for anything that contains loops. I don't know for SoundCloud.


This is an old fight that few users won. At least report it to Apple.

The message says :

It is the same track he published on YouTube that I mentioned in my last post.


In my SoundCloud account, I filed a form and it is now stated under "Disputed copyright claims" that "This dispute is currently under review."

Yes this is an issue and an old one. Especially with Social Media platforms and trolls batch registering everything they found in the platforms automated digital rights management systems. The platforms started to take action. For example, Youtube prohibits registering material to Content ID that include stuff from commercial loops library. Add to that the platforms rules conflicting with local regulations...


I agree, I expect more of that in the future.
