Trash Reappearing After Emptying Bin

I have several files that keep reappearing in my trash bin. The files were originally deleted several weeks ago. I have attempted to remove them both in the UI ("empty trash") and via CLI (rm -rf), but they return within a few minutes.

The files were originally located in iCloud Drive, and "get info" of the files within the bin shows them as being in:

 /Users/xxx/Library/Mobile Documents/com~apple~CloudDocs/.Trash

I am not sure whether this issue existed prior to the Big Sur upgrade.

Well, I can't guarantee that this will work, but may be worth a try.

1) logout from iCloud

2) make sure that none of the files in question remain; deleted them if they are still present

3) go to iCloud website, and check to see if they still appear there; if they do, delete them

4) login to iCloud on your mac again.
