You can buy a replacement remote from Apple or other resellers.

Apple Remote (aluminum) - Apple TV accessories - Apple Store online

Replacement remotes will have to be linked to the device. If your Apple TV remote isn't working - Apple Support. Do not skip step 1, to clear the previous linked remote.
