Do the 40mm bands work on the Series 3 38mm casing?

I am asking because I noticed that the Apple store no longer has 38mm bands available in store

Yes. In most cases, 40mm bands are compatible with 38mm watches. See the Compatibility details link in the store page for the band you want to buy.
