I have the Hard Drive File and under it is the one I want to get rid of. When I unchecked the Finder preference Hard Drive both went away and when I rechecked it both came back. When I control clicked the file and clicked on Get Info this is what I get.
Did you try unlocking the padlock and check ignore ownership...
then delete it.

what type of file?
This sounds more like your drive?
Finder>Preferences>General>Hard Disk uncheck the box

Well if this is an issue you can try deleting from a safeboot, It is simply an artifact from the upgrade process, a bug of sorts
Try a SafeBoot https://support.apple.com/en-us/HT201262
if no resolve you can try disabling SIP and enabling after you are done
