Ready to launch an app however someone is already using the app name

I apologize for messaging on this platform, but I feel out of options. I filed an app name dispute with Apple in August. I have not heard back despite multiple email attempts. I will be ready to launch an app in a few weeks on the App Store, however someone is already using the app name I would like to use. I have the name trademarked, and I reached out to the current user, who is also not responsive. It appears that this person is no longer using their business (links are inactive). If you could provide any assistance with being able to use the name on the App Store, it would be greatly appreciated. Thank you so much for your time.
