Regarding Apple pencil
My Apple Pencil generation 1 is not working. It is in warranty now. There is no damage to the pencil. Can I get the pencil replaced?

Their typical return policy is within two weeks starting from the date of purchase or date delivered to address, whichever is longer and no questions asked.

That's the return policy.
Apple usually offers a one year warranty for hardware, and a pencil will probably be a warranty replacement if it's not working.
This assuming the cause was determined to be a manufacturing problem, and not (for instance) device physical damage.
Contact Apple, and ask them. Use the Get Support link in the upper right of this webpage.
