I just bought a MacBook pro mid 2010 13" and discovered the apple id is keeping me from upgrading to a new operating system ... what can I do

I just bought a 2010 MacBook pro 13" and discovered the old owners apple ID is still there keeping me from upgrading my OS ....also want to upgrade hard drive to SSD ... and have the latest macOS running but can't get past logging into the Ap store ... maybe create a boot drive with the new SSD ... don't know how to do that ... what do I do

Return it to the seller and have them proper prepare it for sale using instructions in this Apple support article:

Otherwise you will never get full use from the device.
