I have found the problem it was because i forgot to connect my phone to the wifi.
Yes, the other person has gone to the apple watch app disconnected the watch and we also disabled the activation lock.
Did the other person follow all the steps on this page;
What to do before you sell, give away or trade in your Apple Watch, or buy one from someone else
If they did not then the watch will be locked and you will not be able to use it until they remove the activation lock.
