like my phone has spy wear on it. Is there anyway for me to check before doing a factory reset.

Unless you jailbroke your phone it doesn’t have spyware on it. And even if you did jailbreak it’s still highly unlikely.
If you don’t have a strong password and 2 factor authentication on your Apple ID then your Apple ID can be hacked (with difficulty, but not impossible). If this is a possibility see→If you think your Apple ID has been compromised - Apple Support. Hacking an Apple ID will still not allow anyone to install spyware on your phone, but they can see anything you back up or sync to iCloud.
