Smart Playlist: different songs on iPhone

I have created a 'not recently played'-Smart Playlist with following criteria:

• Last time played: not in the last the 12 months, AND:
• Playcount: bigger than 5, AND:
• Last time skipped: not in the last 8 months

> Limit to 40 songs, randomly selected

> Live updating.

In my iTunes I see 40 songs which meet these criteria, but when I look on my iPhone I see 40 different songs.

What do I have to do to see the same 40 songs?

Additionally, I checked: once I play one of the 40 songs (I see on my iPhone) in iTunes, it doesn't disappear in the playlist on my iPhone.
