If I buy iPhone 13 pro max from India (the one without the band on the side), will it work fine if I use it in the US?

For any carrier-locked iPhone, it's 100% up to the carrier whether to unlock it, or not. If you do purchase a carrier-locked iPhone, this link shows the steps to take for unlocking it to use with a different carrier: How to unlock your iPhone for use with a different carrier
