Smart playlist on iphone

I build a smart playlist which has 2 rules :

1) Last played before a given date.

2) songs included in a static list.

I would expect the song the be removed from the smart list on the iphone as soon as I played it.

The purpose of this is to be able to play an album not on that list, and resume playing the list from where I last stopped it.

Unfortunately played songs are not removed from the smart play list.

I used to do the same on ipod video and ipod classic, and it worked like a charm. But on iphone the smart playlist behaves like a static one.
