iPhone 14 PRO MAX with problems at refresh rate

a week ago I bought a 14 Pro max, but I am very disappointed with it. before it I had a 14 plus but I wanted to upgrade in the hope that the games and applications would run much better, which turned out not to be the case. in games I have a lag every 5 seconds, a lag that I never had on the old phone. this lag is very annoying and makes games run even harder. I understood that it is about Pro Motion and the software update, and that this problem will be fixed in September when ios 17 will be officially released. In conclusion, I would like to say that on the pro max I use the same settings as on the 14 plus, no nothing has changed. I don't know what to do, whether to take it under warranty or wait for an update. what do you say? thank you

If you bought directly from Apple, you have a 14-day "no questions" return window. That is stated in this Apple policy article:


Returns & Refunds - Shopping Help - Apple


If you bought from a reseller, then their refund policy is all you have.


Regardless of where you bought it, you can have Apple evaluate the phone at the Genius Bar, so that may be the best action if you have an Apple retail store nearby. Best to set up and appontment:
