Image Capture lost my pictures

This is one of the most tragic events of my year, I tried to transfer my pictures from my android phone to my MacBook Over 10000 pictures from past years with my beloved lost people, after the import ws finished I found over 1000 pictures and all the rest was gone, the Image Capture identified 10000 pictures but only transferred a 1000 pictures and deleted everything from my phone, I called support they said we cannot do anything.

What should I do ?

MacBook Air 13″, macOS 13.5

Have you been setting Image Capture to delete the photos directly after the import? Otherwise Image Capture would not erase the photos. The "Delete after Import" option is risky, because you cannot repeat the import, if something goes wrong. It is much better to delete the transferred photos manually, after you have checked that the transfer has been successful and you have made a backup copy on your computer.

To rescue your photos, stop using your phone immediately, then search for data recovery software, that can recover deleted photos from the phone model you are using. I do not know what to recommend for Android devices, but the longer you are using the phone after the deletion the more photos that could still be recovered will be overwritten by new data and permanently deleted.
