Go to settings then general and go to accessibility and toggle assistive touch off
The magic solution! Oh wait.... thats totally un-related. If that was the solution don't you think in roughly 300 pages on this topic someone would have already mentioned that? Excuse my sarcasm.
Since you clearly don't know... Assistive Touch adds a small faded white button that allows users with broken iPhone buttons (home or lock buttons) to return to their home screen or lock the phone. It can also accomodate users who have trouble doing certian gestures (pinch to zoom, three finger scroll, etc). Unfortunately #1 : I can't turn this off because my lock button does not work. Unfortunately #2 : It doesn't have any bearing on whether my ear presses mute or dials buttons while I'm talking on the phone.

My apologies. Perhaps you could explain your experience with this solution a little more?
I have the iPhone 4s and ever since I did the ios 7 update my phone has started not fading out while in a call. Now I'm wondering if maybe it wasn't the update but more of a hardware issue. I think I'm out of the warranty time so that could be an issue. Looks like it may be time to just upgrade my phone cause this is annoying!!!!
