My iPhone 13 Pro is unavailable, how can I regain access?

I have lost my iphone 13 pro 3 days ago and i did a general dairy on the police station. The person took off the sim and tried wrong password. I have been tracking the device and after 3 days i finally found it but the person who stole the phone have tried wrong password so many times. I have all the prove that It is my phone and I want to gain access to the phone including my existing data in it. I will provide all the find my location and the GD copy. Please have a look and see what can do to fix this issue and have my iphone back and the data as well.

See the related article above. The data is lost but you can restore your device from your backup after resetting it.

Most repair shops will help you recover from you being locked out of your phone but if you don’t want to take it to a repair shop you can try using the iTunes app on your computer and manually override the wait X minutes screen. If this doesn’t work try checking out this page If you see an iPhone or iPad unavailable message or Security Lockout screen - Apple Support

No. No backup means no recovery.

my icloud is full and all the things that i have is on my iphone 13. I do not have backup of those and thats why i will not get a chance to restore the data. or is there any other way?
