I found an air tag with a dead battery. I replaced the battery and the tag wants to sync with my phone. There is no message detailing the owner like the instructions say. It wants to sync with my phone. did they mark the air tag as lost and removed form their account. Will contacting Apple with the serial number get the item back to the owner?

No, contacting Apple with the tag's serial number will not result in Apple assisting you with getting it back to its owner.
In this case, the owner may have already removed this tag from their Apple ID. If you reset it, and you now can pair it with your Apple ID, it is technically "yours." However, it is not legally or morally so. You didn't purchase it. I suggest that you take it to your local law enforcement agency. They can work with Apple to identify the owner.
