macbook pro 13inch early 2015 lose data after system update

I updated my system to Monterey 12.7.3 last week, during the updating setup the system cut-paste my "File folder" and "desktop folder " to iCloud. I though that was a normal backup, it took too much space in my icloud so I deleted these two folders in iCloud. Afterwards I find out they were gone from my desk.

this update didn't mention this action will delete those files from my hard drive.

I have contact the support and I have tried "option command PR" and waited for 5 days, keep the laptop online during the whole time and it doesn't work.

The previous support counselor won't reply my emails and voice messages, I have tried to reach her for over 24 hours, what could i do in this situation? to recover my data???

MacBook Pro 13″, macOS 12.7

but my auto backup on Time machine was shut off since 2018, this is an old mac... can I get the recent 5 years data back too?

See if you have any local APFS TM backup snapshots. Here is an Apple article which explains how to see if you have any APFS snapshots (you need to click on the "Data" volume before you will see the option "Show APFS Snapshots..." on the View menu on the menu bar):

If there is a more recent APFS snapshot, then we can provide instructions for mounting it so you can attempt to access the deleted data.

If there are no APFS snapshots, then your 2018 TM backup is your only option unless you stored some of the files elsewhere (USB stick, email, network drive, other external drive). With SSDs, when you delete an item and empty the Trash, the data is permanently gone due to how SSDs work. If the items you deleted bypassed the Trash, then they are just as permanently gone as well. You did check the Trash?

I have cleaned the trash can. yesterday I sent the MacBook to a 3rd party data recovery company they said there is a little chance but no guarantee, I should find out by today. Wish me luck.
