Defective Beats Fit Pro (torn rubber wingtips)

Has anyone had any success in getting Apple to repair/replace the defective rubber wingtips on their Beats Fit Pro earbuds? There is a thread on Apple Support website with 1,100+ comments on it: Beats Fit Pro Wingtips tore off my right … - Apple Community. I had the exact same defect (both earbuds) and Apple said they can't replace the rubber wingtips because they are "fused" to the plastic -- but clearly the rubber is NOT properly fused and that is exactly what is causing the wingtips to tear. I made a Genius Bar appointment and showed them the defective pieces, and the best they offered me was $9 discount off the $178 replacement cost. The Apple technician just kept repeating, "You are beyond your 90-day warranty." I live in California, where there are "implied warranty" laws; are there other CA residents here experiencing this same defect issue who might want to take the issue to the next level? Clearly Apple is not owning up to their responsibilities on this product.
