Did you remove a file from an external disk (eg usb-stick or external drive) to the bin and didn’t empty the bin before disconnecting it? If so, reconnect that disk or stick and try to empty the bin again

On Sonoma 14.5 on an M3Pro MBP and I've just noticed the same problem. This is a fairly new machine so I've not done much with it. Any success yet?
Simple fix for me - just put something into the trash and then tried emptying it. Behaves normally now, just an annoyance bug.
Try and restart the mac to see if the issues persist
Restart in safe mode and see if it clears.
If you have a TM drive connected remove and reboot and see what happens?
When you open the Trash folder is there anything in it? Have you tried Shift-Command-Delete? If it’s empty then I suspect there’s a glitch somewhere that would likely only be fixed by a reinstall of macOS on your machine. Otherwise just earn to live with it.
Of course I restarted the computer a bunch of Times
Hello. Test done in safe mode but the trash bin icon still stays as full :(
