Beats Fit Pro Not detecting Right Earbud

I just got them today, right out of the box the right earbud was not working. it detects it is charging in the case, but once I take them out my phone doesn't detect them anymore. this means I can't hear anything out of them at all. I have firmware up to date, I have already reset them multiple times, any other solution?
