Crack on new iPhone 16 pro max.

Unless the crack was present at the time you first took it out of the box it will 99.9% be seen as cosmetic damage which is not covered under warranty. You can always take it to your local Apple Store or authorized repair facility to have it inspected but go in understanding that if it is deemed to be cosmetic accidental damage it is not Apple refusing to make things right. It’s virtually impossible to prove that accidental damage isn’t the cause even if you can’t pinpoint what may have happened (there are various ways glass screen cracks can occur that do not mean a quality issue or defect). Other than an obvious defect existing which would have likely existed from day one other than something occurring inside the device to cause pressure that would lead to a spontaneous crack (just an example) it is equally difficult to place the blame on Apple. Unfortunately how long you have owned it has nothing to do with when a crack can occur….
Like I said, you can have it inspected and see what happens. No guarantees that they will replace it as courtesy but if you have AppleCare+ you could use that to have it repaired. Or if you paid for it in full with a credit card you could check to see if that credit card provides any kind of coverage for repairs or replacements of items purchased using that card. Lots of cards do but you would need to check and make sure if it does that you meet all of the requirements to get the benefit.
