Blood Oxygen app missing on Apple Watch Series 8 after restoring from iCloud backup

I needed to replace my Apple watch 6 because the face fell off. Since I have suspected COPDthe ox sensor is very important to me so I had to buy a refurbished Apple Watch 8 to hold me over until Apple starts selling watches with the oxygen (Sp02) feature again. When I restored my Apple watch 8, that was advertised as having the OX sensor, using the series 6 backup from my iCloud account, everything looked like my old watch except it said the Oxygen app was no longer available. Several apps I paid for make use of the Sp02 data from the health app and now it’s useless. All Apple Watch 8s are supposed to have the feature and sensor enabled. How can I get this fixed. My watch is listed as supported for this feature and it should have restored from my iCloud account. Thanks!

Yeah, the folks on the phone at Apple were much more kind/less terse in explaining the details (I love Apple Phone Support!). It is based on the model number of the apple watch. All you have told me is what I already learned with a simple google search. The person I spoke with at Apple sent me a link to the info below on same and clarified. It's very clear to me now, what the issue is from what they told me. You would have been more helpful if you pointed me in that direction...

About Blood Oxygen availability

The removal of the Blood Oxygen feature is the result of an intellectual property ruling from the United States International Trade Commission, which Apple is appealing.

The Blood Oxygen feature is no longer available on units sold by Apple in the United States on or after January 18, 2024. These are indicated with part numbers ENDING IN "LW/A"Learn how to identify your Apple Watch.

So, the key is the model number. I checked the model number on mine and it did in fact end in LW/A (NNP13LWA/A). It was advertised to me as Model Number: MNUL3LL/A. I have initiated the return with Amazon's no hassle policy and they are sending me a brand new condition watch with new face, charger, band, new battery and the correct model number. They will also fix the model number discrepancy on the website at Amazon, with apologies for my inconvenience.

Also, again, you are slightly incorrect. It applies to all devices in the US that are sold or otherwise distributed "BY APPLE" after the date of the order. There is no litigation against Amazon for stealing intellectual property. That is on Apple.

Thanks again... I guess.

Thanks for the reply. I am well aware of that but I don’t think that applies here. The specifics of that court order states, as quoted on Apples web site “Apple watches sold by Apple”. This is a refurbished watch series 8 sold by Amazon premium refurbished watches that already had the sensor and the app. The Court order applies to only LATER versions of the Apple Watch 9 and Apple Watch 10, and future release until appeal is upheld or an agreement is met between Apple and the company they stole the Tec from. It never applied to “early” series 9 or any version preceding. Until I reset the series 8 and transferred i.e.: “copied” my old series 6 watch backup to the series 8 watch from my iCloud backup. Meaning, I effectively already bought the sensor and app before the ruling went into effect. The series 8 watch I bought also had the same Sp02 capabilities when Apple sold it AND at the time it was not under court order. Since I was simply transferring my Apple Watch 6 from my iCloud account backup to the series 8 which Apple provides the software for in setting up the new phone from old, they have no right to take away a capability they have already sold me UNLESS I was trying to install it on a watch that Apple sold after the court order went into effect, which would be later series 9 and series 10 at this point. Lastly, note my wife bought a series 9 when they first came out and before the court order went it works fine on her 9 because it is the early model. Apple needs to provide remedy for this situation. Thanks!
