Is this theft by Apple Store miranda

Went into apple in Miranda NSW Australia after making an appointment online the day before to be told that we would have to wait an hour well I thought they must be booked out so we waited an hour then I decided to go back in and ask how long it would be because we waited an hour after making the appointment they said there was a misunderstanding we should have be seen straight away so after seeing 2 more people we sat down.

I told the girl we needed a report on the condition on my partner watch as she feel and broke the screen she started to put a lot of info into her iPad till I told her it’s just a report not a repair job we need so the insurance can cover the cost off a new watch if it’s not fixable she said that it was not fixable but still has a trade in value off $275, she gave us the report and took the watch that I bought for my partner birthday. She said it would go to the work shop to verify its condition for the insurance company I thought but she still gave us the report to give the insurance company. My insurance company has excepted the claim and will deposit the cost of a new phone into our bank so can go and buy a new watch. I ask Apple to return the broke watch but they have refuse saying they are giving us a new watch ( not ) we are paying for the new watch and we paid for the broke watch as well so his belongings to me but they will not return it.

so is this theft even after they said it had a trade in value that I will never see because they are keeping my watch

PS phoned them up and omg the guy was so rude to my part telling her that she not getting both the old watch or the new one so pick one. **** the old one is ours and we where buying the new one am so confused

As Apple doesn’t provide insurance for Watch past any applicable AppleCare+ coverage, you’ll want to follow the procedures established by your insurance provider.


If this damage was to be covered by Apple with AppleCare+, then Apple would have presented you with your options and costs.


And that you’re not going to get both the old broken Watch back and a new or refurb Watch — without paying for the new or refurb Watch — is absolutely expected and correct.


You will want to ask for the broken Watch back, and discuss this with your insurance provider.

You got a lot going on there and I am totally confused on what happened. I can certainly see how they would be confused too. I can only suggest going back to the store and talk to the Store Manager. That is not something you can communicate successfully over the phone. Sorry I could not be more helpful and maybe someone else will have more insight into what happened.

The Apple Intelligence summary of that: “Apple mishandled a watch repair appointment, leading to confusion over a trade-in value and the return of the broken watch. The customer seeks clarification on ownership rights and the insurance claim process.”


When you bring in a watch (or iPhone or iPad) for repair, you will very seldom get the same device back. You will usually get a refurbished replacement back. You’re not going to get both back. Not without paying full price for the refurbished replacement..
