AirPods Max Keep turning Noise Control to "off" if no sound is played. (Specially with MAC)

My AirPods Max keep going back to Noise control to "off" and Noise Cancellation option does not do anything.

if I start playing something, the "Noise Cancellation" option immediately start to work.

Very frustrating, I cant use the AirPods Max when in office to only suppress the background noises.
