Are modified AirPods causing firmware update issues?
I was told by an apple advisor that everyone having problems updating firmware had bought used AirPods that had been modified,and therefore were not covered by apple care.

Very likely or just plain counterfeit AirPods that were not purchased from Apple or Authorized Apple Seller. Of course those won't be covered by AppleCare and you can expect problems with them as well.

Since you post referred to "everyone having problems updating firmware had bought used AirPods", that would indicate a large percentage of them would be counterfeit. There is no serial number check or verification that can be done to confirm a legitimate pair of AirPods when they are purchased new. The serial numbers are just copies of actual numbers, so you think you have Apple Care coverage, but you don't.
The only way to know if you have a legitimate pair of AirPods is to purchase from Apple or Authorized Apple Seller. Buying used AirPods or from any third party is a risky move.
If they were "modified", they are no longer "AirPods" and are not supportable.
