My current phone was giving to me by my company it still has MDM, when i get a new phone and transfer my data will MDM not be installed on the new phone, I dont want them to have access to my new phone.

Take your current phone back to the company. If they 'gave' it to you, as in, told you that you now own it, they need to unenroll it from their MDM and potentially remove it from Apple Business Manager.
